An oil and gas lease might include pipeline easement rights as a provision. For this reason, landowners should examine existing oil and gas leases to determine if pipeline easement rights already exist. If so, the landowner should understand the extent of the easement rights granted in the lease. For example, the lease may allow the oil and gas company to establish gathering lines anywhere on the leased property. Or an oil and gas lease might prohibit the landowner from granting a pipeline easement to another company.
